The terms that govern our site and every strategic engagement.

Effective September 2026. These terms apply to all visitors and prospective clients of Harbour Creative.

Agreement to terms

By accessing this website or submitting a strategic inquiry, you agree to be bound by these terms. If you do not agree, please do not use the site. These terms apply to all visitors, prospective clients, and engaged parties unless superseded by a signed engagement agreement.

Services scope

Harbour Creative provides strategic digital infrastructure, brand positioning, and related creative services. The specific scope, deliverables, timelines, and investment for each engagement are defined in a separate written proposal or statement of work agreed to by both parties. Nothing on this site constitutes a binding offer to provide services, and indicative figures shown on this site are subject to formal proposal.

Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL), including that services will be rendered with due care and skill, be fit for any specified purpose, and be delivered within a reasonable time. Nothing in these terms excludes, restricts, or modifies any right, remedy, or consumer guarantee you may have under the ACL or any other applicable law that cannot lawfully be excluded, restricted, or modified.

Intellectual property

All content on this site — including text, imagery, code, design, and marks — is the property of Harbour Creative or its licensors and is protected under the Copyright Act 1968 (Cth), the Trade Marks Act 1995 (Cth), and other applicable laws. Client-owned materials remain the property of the client. Rights to final deliverables are transferred only as expressly set out in the applicable engagement agreement, and Harbour Creative retains the right to display completed work in its portfolio unless otherwise agreed in writing.

Client obligations

Clients agree to provide timely access to information, feedback, and approvals necessary to complete the engagement, and warrant that any materials they supply do not infringe the intellectual property or other rights of any third party. Delays caused by incomplete or delayed client input may affect timelines and may be subject to adjustment.

Confidentiality

We treat all non-public information shared through inquiries and engagements as confidential. We do not disclose client work, identities, or project details without permission, except where required by law or as necessary to perform the agreed services. Confidentiality obligations survive the completion or termination of an engagement.

Limitation of liability

To the fullest extent permitted by law — and subject always to the non-excludable consumer guarantees under the Australian Consumer Law — Harbour Creative is not liable for any indirect, incidental, consequential, or punitive damages arising from the use of this site or any engagement. Where liability can lawfully be limited, our liability is limited, at our election, to resupplying the services or paying the cost of having the services resupplied.

Dispute resolution

Before commencing court proceedings, the parties agree to attempt to resolve any dispute in good faith, and where necessary through mediation in Sydney, New South Wales. If the dispute remains unresolved thirty days after mediation commences, either party may commence proceedings in the courts of New South Wales.

Governing law

These terms are governed by the laws of New South Wales, Australia. Any dispute arising from these terms or an engagement will be resolved in the courts of New South Wales, and both parties submit to the exclusive jurisdiction of those courts.

Changes to terms

We may update these terms from time to time. The current version will always be posted on this page with an effective date. Continued use of the site after changes constitutes acceptance of the revised terms.
